Has anything changed in your business as far as, I mean, a lot like mine, Joe,

there are changes from time to time where they upgrade different requirements
and stuff,

The code comes out every three years, but sometimes it takes six before they

So it’s basically costing more money to our house because they make you do

Well, we all know with inflation, everything has went up and then there was

years has went up almost doubled from when I moved here 10 years ago.
So, I mean, it’s kind of ridiculous, but, um, that’s just because we have so
many people,

um, you know, moving in Murray County just went berserk to be quite honest.
I don’t know.
You guys still live up, uh, past the, uh, Gallatin up there, right?
Is it busy?
I mean, have you guys had a lot of growth up in that way?
I don’t live up that way.
So yeah, yeah.

Cotton town’s growing, but it’s the big, one of the biggest counties, but
it’s, it’s growing

and a lot new schools and a lot more traffic.

It’s a pleasure to speak with you.
Not only am I very poor, but I am also very stupid.
So therefore I’m not exactly where I need to be with taxes.
And I had a couple of questions.
I could take my answer off the air, but I was just curious if you could name a
couple

of smart things to do.
I just recently started an LLC and you know, you hear about putting things
into your LLC
into your LLC
and what to deduct and whatnot too.
And I just really haven’t.
Can I ask you, are you a business or a real estate?
A business.
It’s a business.
Okay.
Just making sure.
Cause so if you’re a business, obviously everything that we have that goes
into making our business
into making our business
is going to be a tax deduction.
Once you have a profit, theoretically you might want to set up a SEP, a
self-employed
self-employed
retirement plan that you can maximize up to 40, 50 grand a year.
If you, if you had the cash to do that would be a direction you might want to
go.

Obviously writing off particularly maybe a home office or writing off your
car.

Again, not knowing your business.
These are the areas in which you probably need to set up an appointment or, or
talk
talk
to your tax person to really get a checkoff list based on the type of business
you do.

What can you, or can you not write off because of the business that you’re in?

The biggest thing is not confusing your day job.
If you’re a W2 person trying to write any expenses that may tie to that
through your

business.
But, but again, you know, all in all the basics are, you know, all of your
expenses, your
expenses, your
utilities, portion of utilities based on a home office.
You have to have a legitimate home office, not your kitchen table.
If the business requires one.
But other than that, you know, as far as catching up on retirement or setting
money aside, you

kind of need to take the profits if possible from the side business and start
using that.

As far as I know, Airbnb only covers the state sales tax.
They don’t cover the business tax and or which is the County County and city

So I think you still need to be if you want to have it come out, you would
need to be

withdrawing that as part of additional fees through Airbnb, because I think

covering what’s required under the law, which is sales tax and in most cases,

Hey, I have been retired for several years and this is the first time I’ve
made any significant

withdrawals on my IRA.
And it’s a bit more than I’ve really wanted to withdraw.
But I was wanting to find out if they still can offset that by borrowing some
money and

putting that back in the IRA.
You have 30 or 60 days to do that.
And you can only do it once.
Nowadays, you can’t do it more times.
And if you’re outside of that, the only other thing you and I don’t know if
you’ve already
you’ve already
received the money, you can’t do that either, but a qualified charitable
deduction would

have been a direction you could have maybe went.
But other than that, Michael, there’s not a whole bunch.
I mean, if it’s outside that 60 day window, then no, you can’t put it back in.

My mother passed in July of 2022.
She was 90 years old and poor health.
I’m 67 years old.
Anyway, she had a Roth IRA that had been around for about 20 years.
I was designated as the beneficiary.
So my CPA is telling me that the IRS has been trying to change the rules on
RMDs for inherited
RMDs for inherited
Roth IRAs.
I was under the impression that I had 10 years if I wanted to wait that long
before I took
before I took
any RMDs out.
I’m being told now that I will have to take one this year by the end of the
month.

Is that true?
Well, what year did mom pass away?
2022.
It’s been a year and a half.
So yes, they did change the rules a year ago.
Roth IRAs do require RMDs.
It’ll be tax free, but you can’t leave it in there growing tax free.
And you are required within the next whatever money days we have left to this
month to do

that.
So, yes.
Okay.
What about for last year?
Do I want- No.
Mama would have had the year in which you pass away, the RMD has to go to the
person that
person that
passed.
So, she should have taken the RMD.
Okay.
So, I won’t be penalized for that then.
That is correct.
This is a Roth IRA.
Does it make a difference?
They changed the rules on it.
So, even, I mean, there’s no money due, right?
I mean, I’m just saying when we take the money out of a Roth, basically in
five years or

over the age of 59 and a half, both of those are applied for both you and your
mother were.

So at this point, money you’re taking out is tax free, but you still have to
take an

RMD now out of a Roth IRA, inherited Roth IRA, I should say.

Otherwise, there’s a big penalty for it.

So, you know, they’re looking for ways of getting their hands on your
retirement.

So, every year from now on, I have to take an RMD from that inherited Roth

Well, my dad passed away three years ago at the end of 2020 and everything
went through

probate and everything and there were two amended tax returns, both needed a
refund.

Well, the one from 2020, they refunded the money last summer, but 2019, they
keep…

Every time the lawyer calls them, like about every two months, they keep…
Even though we’ve gotten a discrimination that they owe money for 2019 to the
estate,

they keep telling him that it’s still under review and that it’ll be 30 days.
Well, the last time he sat on the phone with them was October 5th.
So there’s still no refund.
So we can’t close out the estate.
So is there any way to get the IRS to move on this?
They had already made a determination, but they’re not doing anything.
I would love to say the answer to that is yes.
But as we probably have been listening long enough to know, there’s nothing
really you
really you
could do.
And hopefully he has documentation of when this amended return was done,
because 2019,
because 2019,
if someone were to file one now, we would not get a refund because it’s
outside of the
outside of the
three years.
But hopefully that was filed within the three years and someone has a paper
trail showing
trail showing
that.
Oh yeah, this has been going on for two years now.
Okay, good.
Well, I mean, not good that it’s been doing, but good that it was filed within
the proper
the proper
time period.
I’m telling them, you know, 30 days and then nothing happens.
It’s a determination that they took for a refund, but now they’re saying that.
The reason for the amendment is what’s causing the question.
Is it really legitimate reason for amendment?
And I don’t know.
But they had already determined that it was, and already had sent the
paperwork saying

that a refund was owed.
But then it went into review or audit because of the…
Well, I mean, you might want to talk to your attorney and tell them that you
want to have
want to have
a 911 file with the tax advocate office, because then they could go at the tax

in Nashville is awesome.
They will at least get in the middle and be able to go onto the IRS computers,
which your
which your
attorney or myself, none of us can see, right?
And they can go in there and see what’s holding it up.
Is it the person that’s processing it has been on vacation or out for sick
leave and

it’s just sitting on a desk?
Well, they’ve been out for vacation for a couple of years then.
Yeah, well, you know, or maybe it’s been misplaced, you know, just keeps
getting pushed to someone
getting pushed to someone
else’s desk.
I don’t have a good answer, but I would suggest talking to your attorney and
just saying,

Hey, you know, someone suggested going to the tax advocate office, filing a
911 so that

they can get final resolution.
It’s been long enough not to have that happen.
This has been crazy.
Yeah.
We can’t close the estate.
And I said, I said, well, can we just, you know, not even take the refund the
hell with

it?
We need to close this thing out.
But you know, you close it and then they’re going to turn around and want you
to do the

other.
So then you won’t be able to cash the check or anything.
So yeah, exactly.
Well, hopefully that will help you a little bit.

But there isn’t anything you can do.
So do they ever go after people politically?
Do you know that?
Well, I mean, there are people that believe that.
But I will like, I mean, there are some people, uh, Valentine was a big guy
that always believed

he was audited multiple times because of his political belief.
But it happened to my father.
And I’m just wondering if, if because it’s my dad and because my cousin who’s
involved,

who’s a Supreme Court justice.

Hopefully we haven’t gotten to that point.
